Uttar Pradesh: Viral Video Of Student Thrashed In Muzaffarnagar School: What Child's Parents, Teacher Said; What Action Police Took; What Are New Developments?


Muzaffarnagar: After the video of a Muslim child being beaten up in a private school in Muzaffarnagar, Uttar Pradesh, went viral, the controversy is deepening. Leaders of Opposition parties have also given strong reaction to the incident.


After the video went viral on Saturday, a case has been registered against the school teacher Tripta Tyagi under sections 323 and 506 of the IPC on the basis of the complaint of the child's father. These sections are related to causing simple hurt and willful insult.


Khatauli police officer Dr. Ravi Shankar Mishra said, "A case under sections 323 and 506 of the IPC has been registered against the director of Neha Public School, Tripta Tyagi, at the Mansoorpur police station on the complaint of the child's father, Irshad."


Case under Sec 123 not registered against teacher


But the district police has not used Section 123 A for the alleged comments made by the teacher against a particular religion. When asked about this, the police officer said, "Investigation is going on. Whatever facts will come to the fore, due action will be taken accordingly."


In this whole matter, the child's mother Rubina says, "Madam has done wrong. She should not have made the other children beat my son. She could have beaten him herself."


Rubina said, "It seems that madam is against Muslims. This is what it appears from the video."


This incident is being given a communal colour: Teacher


On the other hand, Tripta Tyagi, director of Neha Public School, believes that this incident is being given a communal colour.


Tripta said, "This case is cooked up. I have been implicated under a conspiracy. I do not make any distinction between Hindus and Muslims and had no such intention. Most of the children in my school are Muslims. Muslim children were also among those who beat up the child."


Tripta Tyagi said that she was not ashamed of her act.  She said she had served the people of the village as a teacher and they all were with her.


She sought to justify her action, saying that it's important to control the kids at school.


"They have made laws, but we need to control the children in schools. This is how we tackle them," Tyagi said.


She further stated that Hindus and Muslims in the area stay with unity in the area. "The video that was made viral was edited and cut. There was pressure from the parents of the child to be strict with him. I am handicapped I can’t get up…he was not doing homework for last 2 months…so I made 2-3 students beat him up so that he would start doing his work,” Tripta Tyagi said.


“What I said was 'Muhamdan mothers' must not take their kids to their uncles’ homes as the exam is approaching. But they cut this video and took the 'Muhamdan' word…I had no such intentions…," she added. 


No Hindu-Muslim issue: Child's father 


However, in this case, the child's father Irshad says, "There is no Hindu-Muslim issue in this, only the matter of beating the child. They were torturing my child. We have lodged an FIR. Now the administration will take action."


Human rights lawyer files complaint


In new development in this case, Lucknow's human rights lawyer SM Haider Rizvi has filed a complaint with the National Human Rights Commission, the National Commission for Minorities and the National Commission for Protection of Child Rights regarding this matter.


In this complaint, he has demanded registration of cases against the teacher for promoting hatred and insult on religious grounds under sections 153A, 295A, 298.


SM Haider Rizvi says, "I have seen all the three videos, you see that the teacher is speaking against Muslims and instigating small children to assault a Muslim boy. That's why I have informed the concerned commissions." 


When told that the child's father has rejected any religious in this whole issue, Rizvi says, "It is natural, the reason for this is also clear. Listen to the father's earlier statement, he did not want to file any complaint at all. When the matter came into limelight, the administration obtained a complaint from boy's father. "


'Police have not registered case under relevant sections'


Rizvi said further, "But police have not registered case under the relevant sections, it is also a violation of the Supreme Court's instructions on the hate speeches that promote hatred. The district police administration should have taken suo motu cognizance."


Muzaffarnagar District Magistrate Arvind Mallappa Bangari says, "The viral video has been investigated. The video was filmed and made viral by the child's uncle. Legal action will be taken according to the facts that come out in the investigation."


Bangari said the Child Welfare Committee is giving counselling sessions to the child. 


NCPCR notice to DM, SP


National Commission for Protection of Child Rights (NCPCR) chairperson Priyank Kanoongoo said that notices have been issued to the District Magistrate and Superintendent of police in the Muzaffarnagar student ill-treatment case.


NCPCR chief Kanoongo said that the instructions have been given to Muzaffarnagar SP to register an FIR in the matter.


Kanoongo said, "We have noticed an incident from Muzaffarnagar where a teacher made children beat another child. We have issued notices to DM Muzaffarnagar and SSP Muzaffarnagar. We have directed them to submit separate reports to us. We have directed the SP to register an FIR in this matter and give us a report."


Kanoongo said that district magistrate, Muzaffarnagar has been directed to inquire about the certificate of the school.


"We have directed the DM to inquire about the school certificate, its teachers, and their qualifications. We have directed the CWC to provide counselling to all the children whether the ones used for the violence or the ones who faced the violence. We have also directed that any such viral video that discloses the identity of the children should be removed from all social sites. And legal action should be taken against those who have made it," he said.
