W Bengal: What PM Modi said on cancellation of OBC certificates by Calcutta High Court? What will be impact of HC's decision? What Mamata said?


Prime Minister Modi commented on the cancellation of OBC certificates by the Calcutta High Court, stating that the court had dealt a big blow to the Indian Alliance. He criticized opposition parties for politicizing the court's decision, alleging that the West Bengal government had issued OBC certificates to Muslims indiscriminately for the sake of garnering votes.


The Calcutta High Court issued an order on Wednesday to cancel all OBC certificates issued in West Bengal after 2010, citing administrative oversight in the issuance of these certificates.


 The court said that these certificates were given without following any rules. The bench of Justice Tapabrata Chakraborty and Justice Rajashekhar Mantha gave this decision on a petition in which the process of giving OBC certificate was challenged.


This decision of the High Court is a big blow for Mamata government because due to this, all the OBC certificates given by her government have been cancelled. The court has ordered to cancel the certificates given after 2010. Whereas, Mamata Banerjee is the Chief Minister of West Bengal since 2011.

PM Modi said, “This Khan Market gang is a partner in this sin. These are the people who say that Muslims have the first right on the country's resources. These people are continuously giving government lands to the Waqf Board. They are asking for votes in return. These people want to reserve fifteen percent of the country's budget for minorities."


Modi said, “These people also want to give loans from banks on the basis of religion. They want to give government tenders on the basis of religion. They want to give entry to the players in the camps on the basis of religion. This is the height of vote bank politics.”


Modi said that opposition parties are opposing CAA to please their vote bank.


PM Modi emphasized that when he speaks about issues concerning Muslims, he is accused of promoting communalism, even though he claims to be exposing their divisive actions based on facts and realities.


What will be impact of HC's decision?


This decision of the High Court is likely to affect about five lakh people. This decision means that all the OBC certificates issued between 2010 and 2024 will now be considered invalid.


What about those who have jobs?


The High Court has made it clear in its order that during this period, those who have been placed in government jobs will not lose their jobs. The court made it clear that their jobs will continue. The court also made it clear that it will not have any impact on those who are in the recruitment process.


After this decision, OBC certificates issued between 2010 and 2024 will be cancelled. The High Court also said that from now on these 77 castes of the Muslim community cannot be employed by giving reservation.


Along with this, the court also said that no benefit of reservation will be available under the 2012 law.


A new list of OBCs will be made


Now a new list of OBCs will be made on the orders of the High Court. The High Court said that the Backward Classes Welfare Department should now prepare a new report after taking advice from the Backward Classes Commission. This report should tell who is to be included in Other Backward Classes (OBC) and who is to be kept out. After the report is ready, it should be presented in the Assembly.


Mamta said she'll not obey order of HC and BJP


West Bengal Chief Minister Mamata Banerjee has made a strict comment on this decision. Mamta Banerjee said that she will not obey the orders of the High Court and BJP. OBC reservation will continue in the state.


Mamta government now has two options. First, file a review petition against this decision of the High Court. And secondly, this decision can be challenged in the Supreme Court.
