Badlapur Encounter: Bombay High Court on Wednesday raised questions on the encounter of Akshay Shinde, accused of sexually abusing two nursery girls in Thane's Badlapur.
The court asked the Maharashtra government - How can we believe that 4 officers could not handle an accused. He was handcuffed too, if it was a situation of self-defense then the accused should have been shot at the leg, not in the head.
The bench said - If the officer who fired the shot is an Assistant Police Inspector, then he cannot say that he did not know how to react. He should know where to fire.
The court said - As soon as the accused pressed the trigger, 4 people could have easily overpowered him. He was not a very strong man. This is very difficult to accept. This cannot be called an encounter.
Akshay's father has filed a petition in Bombay High Court demanding an SIT investigation into the encounter. A bench of Justice Revati Mohite Dere and Justice Prithviraj Chavan heard the matter. Addressing the bench, petitioner Anna Shinde's counsel said the accused met his parents a day before the incident and was in no mental state to perform any of the acts alleged by the police.
"In the present case, the police is deciding who is convicted. The rule of law must prevail. This is setting a bad example (and) encouraging police to commit such...," the counsel said, seeking a court-monitored probe into Shinde's death.
The next hearing will be held on October 3.
Meanwhile, the custodial death of Akshay Shinde, meanwhile, has set off a hoardings spree in Maharashtra.
Hoardings congratulating Deputy Chief Minister Devendra Fadnavis have come up in various locations in Mumbai. They use a wordplay -- Badla Pura (revenge complete) -- and show Fadnavis holding a gun. These hoardings do not carry any organisation's name.
