On Monday, the Supreme Court addressed the rape-murder case of a trainee doctor from Kolkata's RG Kar Medical College and Hospital, which occurred on August 9. A bench comprising Chief Justice DY Chandrachud, Justice JB Pardiwala, and Justice Manoj Mishra examined three key issues: the CBI investigation report, the doctors' strike, and the facilities for CISF personnel.
The CBI's status report revealed several concerning details, including a 14-hour delay in filing the FIR and the absence of important documents. The court expressed skepticism regarding the circumstances surrounding the case and instructed the state government to present the missing documents in court.
In contrast, concerning the strike, the court has directed the doctors to resume their duties immediately. The Chief Justice of India stated, "If the doctors do not return to work by 5 pm on Tuesday, the state government is permitted to take action against them. The primary role of doctors is to serve patients."
CJI said if the doctors report for duty on or before 5 pm tomorrow (Tuesday), no disciplinary action will be taken against them. However, if the doctors continue to stay away from work, disciplinary action can be taken against them.
CJI said further we will give a direction that if the doctors do not return to work, we cannot stop the state government from taking disciplinary action against them. If they return to work, no action will be taken against them as we are aware of the matter.
Additionally, regarding the facilities for CISF personnel, the court instructed the state's Home Secretary to ensure housing for all personnel assigned to the hospital. These personnel, tasked with providing security, should also receive additional security equipment. The next hearing in this matter is scheduled for September 17.
