ED Summons: No Immediate Relief To K Kavitha From SC, Hearing On March 24

New Delhi: The Supreme Court will hear on March 24 the petition challenging the Enforcement Directorate's (ED) action action against K Kavitha, daughter of Bharat Rashtra Samithi (BRS) party president and Telangana Chief Minister K Chandrasekhar Rao.

A bench headed by Chief Justice DY Chandrachud declined urgent hearing of Kavitha's plea seeking an immediate stay on the ED's summons and said it would hear it on March 24. Kavitha is also a member of the Telangana Legislative Council.

K Kavitha has moved the Supreme Court challenging ED summons in relation to the Delhi Excise Policy case.

She was questioned by the agency on March 11 and is required to appear again on March 16.

ED summon against the law: Kavitha's counsel

During the 'Special Mention' before the bench, Kavitha's counsel had sought urgent hearing of the petition, contending that the issuance of summons by the ED to summon the petitioner for questioning, being a woman, was completely against the law.

Kavitha claims that she is not named in the FIR and that the summons are in violation of Section 160 CrPC which stipulates that no woman shall be required to attend as witness at any place other than the place in which she resides. Kavitha has been asked to appear before ED in Delhi, purportedly to confront her with an arrestee in the case.

She said ED gave her a very short notice for appearance and denied her requests to be examined at her residence or to extend the date of examination. .
