Grieving mother knocks Bombay High Court's door for her dead son's sperm, court gave this order


A grieving mother has knocked the door of the Bombay High Court for the sperm of her dead son following his death. She has filed a petition in the Bombay High Court in hopes of using it to support her family’s future. The woman told in the petition that both her husband and son have passed and there is no man left in the house. In such a situation, she wants to carry forward the family's lineage with the semen of her son.

The petitioner's son had cancer and died while battling cancer. He had frozen his sperms and kept them in the sperm bank, but after the death of the son, the fertility center refused to give the semen to his mother. The Bombay High Court has ordered a fertility center to keep the frozen sperm of the deceased youth safe till the decision in the case is taken.

Court orders fertility center to keep the semen of the youth safe 

The petition came up for hearing before a bench headed by Justice Manish Pitale. On this petition, the judge said that if the semen of the youth is damaged or destroyed before the hearing is completed, the purpose of the petition itself will fail, so the court has ordered the fertility center to keep the semen of the youth safe till the settlement of the petition.

Son had chosen to destroy his sperm after his death

In the petition, the woman said that when her son was diagnosed with cancer, an oncologist advised him to freeze his sperm, as chemotherapy can destroy sperm. The son signed a form without consulting his family and chose to destroy his sperm after his death.

After this, on February 16, the youth died without writing a will and now the fertility center has refused to give the sperm. The woman told in the petition that both her husband and son have died and there is no man left in the house. In such a situation, she wants to carry forward the family lineage with the semen of the son.
