Bill to remove PM, CM and Minister from post introduced in Lok Sabha, why is Opposition opposing?
Union Home Minister Amit Shah has introduced the 130th Constitution Amendment Bill, 2025 in the Lok Sabha, which has been strongly opposed by opposition MPs.
This bill provides for the removal of those ministers of the Center and the State who have been detained or arrested for at least 30 days in case of corruption or serious crime.
Till now there was no such provision that a minister, Chief Minister and Prime Minister could be removed from the post on the basis of allegations. Till now, MPs and MLAs lose their membership only after being convicted.
Bill sent to JPC
However, this bill has been sent to the Joint Parliamentary Committee (JPC) which will present its report on the first day of the next parliamentary session.
Home Minister Amit Shah has said that the opposition will get an opportunity to register its objection before the JPC.
According to the draft bill, if a minister is arrested and detained for 30 consecutive days while in office on charges of committing a crime under any law, which provides for a punishment of five years or more, he will be removed from office by the President on the advice of the Prime Minister. This should happen on the 31st day of detention.
Completely unconstitutional, undemocratic: Priyanka
Congress leader Priyanka Gandhi said, "I find this completely harsh because it is against everything. Calling it an anti-corruption measure is like putting a veil over people's eyes. Tomorrow you can file any case against any Chief Minister, arrest him for 30 days without convicting him, and he will no longer be a Chief Minister. This is completely unconstitutional, undemocratic and very unfortunate."
BJP govt wants to turn our country into a police state: Owaisi
AIMIM MP Asaduddin Owaisi said, "This bill is unconstitutional. Who will arrest the Prime Minister? The BJP government wants to turn our country into a police state through these bills. We will oppose them. The BJP is forgetting that power is not forever."
Only two days are left in the monsoon session of Parliament. The monsoon session is ending on August 21.
This is aimed at targeting the opposition: Singhvi
About this bill, Congress MP and Supreme Court lawyer Abhishek Manu Singhvi said, "This is aimed at targeting the opposition. There are no rules being followed in these arrests. The arrests of opposition leaders have increased, and there is big inconsistency in them. The new proposed law will remove the current Chief Minister after 30 days of arrest. This is the most effective way to destabilize the opposition."
Singhvi further said, "Central agencies will be misused to arrest opposition Chief Ministers, and despite failing to defeat them in elections, government can arrest and remove them arbitrarily! Meanwhile, nothing has ever happened to any current Chief Minister of the ruling party."
The monsoon session is going to end on August 21 and the government does not even have a two-thirds majority in Parliament, so what is the meaning of bringing this bill?
TDP may not agree on this bill
Some political analysts said that Chandrababu Naidu's TDP will agree on this bill. Narendra Modi is the Prime Minister only because of the support of TDP. They say the purpose of this bill is to create an environment that the government is very strict about criminalization of politics and corruption.'
CPIML General Secretary Dipankar Bhattacharya criticized this bill and said that it is a direct attack on the parliamentary democratic system. Dipankar said that through this bill, the misuse of central agencies ED, CBI, I-T and NIA will increase.
