While hearing the high-profile Twisha Sharma case on Monday, the Supreme Court made significant observations, signaling that the investigation into the matter should now be handed over to the Central Bureau of Investigation (CBI). The Court stated that since one of the accused in this case is a former judge, a CBI inquiry appears necessary to ensure an impartial investigation.

During the hearing, the Supreme Court also expressed concern regarding media reporting and public statements surrounding the case. The Court noted that the kind of atmosphere being created around the matter could potentially prejudice the investigation. Appealing to the media to exercise restraint, the Court stated that statements made by the families of both the victim and the accused should not be continuously broadcast.
The Court observed, “We are pained to witness certain developments. We request our friends in the media not to continuously broadcast statements made by the victim's family or the other family involved. Let the investigation proceed in accordance with the law and established procedure.”
During the hearing, Solicitor General Tushar Mehta, appearing on behalf of the Madhya Pradesh government, informed the Court that a second post-mortem of Twisha Sharma had been conducted in Bhopal following directives from the Madhya Pradesh High Court. He further apprised the Court that the most critical development at present is the Madhya Pradesh government's recommendation to hand over the investigation of this case to the CBI.
Tushar Mehta assured the Court that he would coordinate with the relevant officials to ensure that the CBI takes charge of the investigation as expeditiously as possible. In response, the Supreme Court remarked that, given the sensitive nature of the case, an impartial investigation is absolutely imperative.
During the proceedings, the Court also issued a stern message to the families of both the victim and the accused. The Court stated that families should refrain from making statements to the media; instead, if they wish to present any information or state their position, they should record it before the investigating agency. According to the Court, making statements on public platforms could influence the investigation and raise questions regarding its impartiality.
The Court explicitly stated, "We wish to urge both the victim's family and the accused's family to present their side before the investigating agency—rather than making statements to the media or on public platforms—so that the ongoing investigation is not adversely affected."
The Supreme Court also advised the media to exercise particular caution. The Court observed that filming or broadcasting the statements of potential witnesses could have an undue impact on certain aspects of the investigation. The Court emphasized that the investigating agency must be allowed to function independently.
Furthermore, the Court appealed to the general public to refrain from spreading rumors and speculation, and to place their trust in the investigating agency. The Court expressed confidence that, in due course, the investigating agency would bring the case to a logical conclusion.
During the hearing, the Supreme Court also clarified that it had not expressed any opinion regarding the allegations leveled in the case. The Court stated that verifying the veracity of the allegations and examining the various facets of the case falls within the purview of the investigating agency, which alone will conduct an impartial scrutiny of all the facts.
The Twisha Sharma case has remained a subject of continuous discussion for some time now. Given the sensitive nature of the case, the involvement of influential figures associated with the accused, and the persistent public commentary surrounding it, the matter has been making headlines on both legal and political fronts.
Following the Supreme Court's observations, it is now considered almost certain that the investigation into the case may soon be handed over to the CBI.
