A Delhi court on Wednesday stayed the order of further investigation against BJP leader and Delhi Law Minister Kapil Mishra for his alleged role in the February 2020 riots till April 21.
Special Judge Kaveri Baveja has stayed the order after Mishra filed a petition against the decision of the Magistrate Court.
The court has also issued a notice to complainant Mohammad Ilyas, on whose petition the magistrate had ordered the registration of an FIR. The complainant has been asked to respond by the next date of hearing i.e. April 21.
In January 2020, the Delhi Police had filed a complaint against Kapil Mishra regarding his controversial tweet.
In this tweet, Kapil Mishra compared the Delhi Assembly elections to an India vs Pakistan contest.
Kapil Mishra was accused of making controversial statements like "Entry of Pakistan in Shaheen Bagh" in the electronic media.
He is also accused of making similar tweets on his Twitter handle (now X) on 22 and 23 January 2020 with the aim of creating a feeling of animosity between different communities during the Delhi Assembly elections and taking advantage of it.
Mishra was an AAP MLA before joining BJP
Before joining the Bharatiya Janata Party (BJP) in 2019, Mishra was an Aam Aadmi Party (AAP) MLA representing Karawal Nagar in the Sixth Legislative Assembly of Delhi. He is also vice president of the Delhi BJP.
He served as the Water Resources Minister in the AAP-led government in Delhi under Arvind Kejriwal. He was later removed from the cabinet amid allegations of irregularities in his ministry's work. Subsequently, he accused Kejriwal and former Health Minister Satyendar Jain of corruption, claiming a bribe of ₹2 crore had been exchanged. He approached the Anti-Corruption Bureau of Delhi with these allegations but could not substantiate them. Later, the Lokayukta dismissed Kejriwal’s name from the case due to a lack of evidence.
