The Supreme Court will hear the petitions challenging the validity of the Waqf (Amendment) Act, 2025 on 16 April 2025. A bench headed by Chief Justice Sanjiv Khanna, also comprising Justice Sanjay Kumar and Justice KV Vishwanathan will hear these petitions.
According to the case list uploaded on the Supreme Court website, this case is listed as item number 13. Many organizations and leaders have approached the Supreme Court regarding this Act, stating that this Act discriminates against the Muslim community and violates their fundamental rights.
The central government has also filed a caveat petition in the Supreme Court so that no adverse order is passed on it without hearing the side. This caveat is an indication that the government wants to put its stand strongly on this issue.
President Droupadi Murmu on 5 April 2025 approved the Waqf (Amendment) Bill, which was earlier passed after lengthy debate in both the Houses of Parliament.
The leaders and organizations who have filed a petition against it include AIMIM MP Asaduddin Owaisi, Congress MPs Mohammad Javed and Imran Pratapgarhi, AAP MLA Amanatullah Khan, Azad Samaj Party chief Chandrashekhar Azad, Samajwadi Party MP Zia ur Rehman Barq, Jamiat Ulema-e-Hind's Maulana Arshad Madani, Kerala Sunni organization Samastha Kerala Jamiatul Ulema, SDPI, IUML and Association for Protection of Civil Rights (APCR).
AIMPLB (All India Muslim Personal Law Board) has also challenged the Act in the Supreme Court. The board says that this amendment is arbitrary, discriminatory and exclusion based. At the same time, RJD MPs Manoj Jha and Faiz Ahmed and Bihar MLA Mohammad Izhar Asfi have also challenged it, saying that this will increase government interference in Muslim religious institutions.
DMK leader A Raja, who was a member of the Joint Parliamentary Committee on the Waqf Amendment Bill, has also challenged the law.
