Places of Worship Act: Supreme Court halts lower courts from issuing any order including survey till next hearing, check details


In an important ruling on Thursday, the Supreme Court addressed several petitions challenging the validity of certain provisions of the Places of Worship Act. The court has mandated that no new cases challenging this law be filed anywhere in the country while the matter is under the consideration of the top court.


During the proceedings, the Supreme Court said, "As this matter is pending before this court, we find it appropriate that no new cases should be registered. No effective interim or final orders should be issued in cases pending in any court until the next hearing in the Supreme Court. This includes any orders related to surveys."


Besides, the Center has been told to submit an affidavit regarding this issue.


The Places of Worship Act stipulates that the status of religious places in India cannot be changed from what it was on August 15, 1947. Senior advocate Rakesh Dwivedi, representing petitioner Ashwani Upadhyay, argued that the court should not issue orders without hearing both parties. 


However, Chief Justice Sanjeev Khanna stressed that he is examining the constitutional validity, outline, and scope of this law. This necessitates a halt to the hearing of pending cases nationwide.
