Shiv Sena Bhavan Likely To Remain With Uddhav Faction; How Remaining Assets Be Divided; Shinde Faction Also Eyeing MPs And MLAs Of Rival Group

Mumbai: Who will get the Shiv Sena Bhavan, how the remaining offices, assets and funds of Shiv Sena will be divided, who will get what, these questions have arisen soon after the Election Commission recognized Shinde faction as the real Shiv Sena and allotted the party name and the bow and arrow symbol to it. 

Shiv Sena currently has assets worth Rs 191.82

Shiv Sena currently has movable and immovable assets worth Rs 191.82 crore, the Shiv Sena Bhavan in Dadar is also occupied by the Uddhav faction. 

Apart from this, there are 280 branch offices in Mumbai and 82 in different parts of the state.

Eknath Shinde, who was very close to Balasaheb Thackeray, joined the BJP about 6 months ago and is currently the Chief Minister of Maharashtra.

Sena Bhavan is owned by Shivai trust

The Sena Bhavan in Mumbai's Dadar is owned by the Shivai trust which is controlled by the Thackeray family and is not in the name of the party. Earlier too Uddhav Thackeray had said the Shinde faction has no chance to stake claim on Shiv Sena Bhavan.

This matter can be decided by a civil court if either side decides to move it.

Eknath Shinde is now all set to build a new Shiv Sena under his leadership. Apart from constituting the party’s new national executive body, Shinde is exploring a few options to set the party’s new headquarters.

Property and funds will automatically go to new Shiv Sena

According to the existing constitution, the entire property and funds will automatically go to the new Shiv Sena once it takes over the party and appoints the treasurer. The question is that in the coming time there are municipal elections in many cities of the state including Mumbai. If funds are needed, will Shinde's Shiv Sena leave this fund?

Shinde faction is now eyeing MPs and MLAs of Uddhav faction

According to political experts, the Shinde faction is now eyeing the MPs and MLAs of the Uddhav faction as well. A whip will be issued to all the MLAs and MPs of the party ahead of the budget session starting on February 27. Only 10 MLAs and 2-3 MPs are left with Uddhav Thackeray, after this whip they too will either have to leave the party or join the Shinde faction.

Shinde has been saying that he does not want the party's property and funds, but advocate Kapil Sibal, appearing in the Supreme Court on behalf of the Uddhav Thackeray group, told that the Shiv Sena office has been captured. 

If the decision of the Election Commission is not stayed, then the Shinde group will also get their bank accounts. Now all this is expected to be decided in the ongoing hearing in the Supreme Court. The next hearing can be held on March 15.

EC has no role in deciding issue of dividing properties 

EC has no role in deciding the issue of dividing properties between the two factions. When the EC ruled on a dispute between factions of the Congress in January 1971, it said it could only rule on the use of the registered name and symbol under the Election Symbols (Reservation and Allotment) Order, 1968.

Meanwhile, amid the ongoing political tussel in Maharashtra, Deputy Chief Minister Devendra Fadnavis said recently that the BJP will give adequate representation to Shinde-led Shiv Sena in 2024 Lok Sabha elections. BJP and the Shinde-led faction will contest as alliance partners in all elections.
